Non-Custodial Disclosure

Last Updated: May 12, 2026

This Non-Custodial Disclosure ("Disclosure") explains the operational structure of CrypTap and the responsibilities associated with using CrypTap's website, hardware devices, APIs, merchant dashboards, software applications, smart contract infrastructure, blockchain interaction systems, operational wallet infrastructure, and related services (collectively, the "Services").

This Disclosure is intended to provide transparency regarding the non-custodial nature of CrypTap, transaction authorization and settlement flows, operational smart contract infrastructure, locally generated device-wallet architecture, user and merchant responsibilities, blockchain-related risks, and the limitations of CrypTap's control over user assets and blockchain infrastructure. By accessing or using the Services, users and merchants acknowledge and accept this Disclosure.

1 Non-Custodial Nature of CrypTap

CrypTap operates as non-custodial blockchain payment infrastructure. CrypTap does not custody customer funds, custody merchant funds, hold customer private keys, hold merchant private keys, maintain pooled customer balances, maintain pooled merchant balances, operate omnibus accounts, maintain escrow accounts, hold merchant settlement balances, provide custodial wallet services, or operate as a bank or deposit-taking institution. At all times, users and merchants maintain sole control over wallets, private keys, seed phrases, blockchain accounts, digital assets, and merchant-controlled CrypTap devices.

2 Direct Wallet-to-Wallet Settlement

Transactions facilitated through CrypTap are executed directly through blockchain networks and third-party wallet infrastructure. Customer funds are transmitted directly from customer-controlled wallets to merchant-controlled settlement wallets. CrypTap does not take possession of customer transaction funds, temporarily custody user assets during settlement, maintain customer deposit accounts, maintain merchant deposit accounts, control merchant payout wallets, route or redirect customer settlement funds after authorization, or pool or aggregate customer or merchant balances.

3 Smart Contract Infrastructure

CrypTap may utilize smart contract infrastructure to facilitate payment-intent creation, operational blockchain execution, transaction-routing logic, protocol-level fee processing, and merchant payment interaction systems. Users and merchants acknowledge that payment interactions may involve smart contract deployment or execution, blockchain payment flows may interact with CrypTap protocol infrastructure, smart contracts operate on blockchain networks outside CrypTap's direct control, and smart contract execution may require blockchain gas balances. CrypTap does not guarantee uninterrupted or error-free smart contract operation.

4 Device-Based Operational Wallet Infrastructure

Certain CrypTap hardware devices may contain locally generated and locally stored cryptographic keypairs used solely for operational blockchain interactions. Users and merchants acknowledge and agree that operational device keypairs are generated locally on CrypTap hardware devices during setup, operational device private keys remain locally stored on merchant-controlled CrypTap hardware devices, operational device private keys do not leave the CrypTap hardware device, CrypTap does not centrally store or custody operational device private keys, and CrypTap cannot access, retrieve, export, or recover operational device private keys. CrypTap does not maintain custody or control over operational device-wallet balances, operational blockchain gas balances, or locally stored device-wallet credentials.

5 Merchant Operational Responsibilities

Merchants remain solely responsible for maintaining accurate merchant payout wallet addresses, securing merchant wallets and devices, maintaining operational gas balances where applicable, maintaining physical control of CrypTap devices, ensuring compatibility with supported blockchain networks and wallet software, and reviewing blockchain transactions and smart contract interactions before authorization. Merchants acknowledge that insufficient operational gas balances may result in failed smart contract execution, failed payment-intent deployment, delayed blockchain interaction functionality, and interrupted payment flows.

6 Transaction Authorization & User-Controlled Signing

Blockchain transactions initiated through CrypTap are authorized and cryptographically signed by user-controlled wallets, merchant-controlled wallets, merchant-controlled CrypTap devices, and third-party wallet applications. CrypTap does not independently initiate blockchain transactions on behalf of users or merchants without authorization. Users and merchants remain solely responsible for reviewing transaction details, verifying wallet addresses, selecting compatible blockchain networks, authorizing transactions, and reviewing transaction amounts, gas fees, and smart contract interactions prior to approval. CrypTap cannot reverse blockchain transactions, recover digital assets sent to incorrect wallet addresses, freeze confirmed blockchain transfers, alter blockchain settlement instructions after authorization, or recover lost operational device private keys.

7 Wallet & Private Key Responsibility

Users and merchants remain solely responsible for wallet security, private key management, seed phrase protection, device security, operational device-wallet security, access credentials, and backup and recovery procedures. CrypTap does not have access to customer seed phrases, merchant seed phrases, wallet credentials, recovery phrases, or operational device private keys generated locally on CrypTap hardware devices. Loss, compromise, corruption, or unauthorized disclosure of private keys or seed phrases may result in permanent loss of access to digital assets.

8 No Discretionary Financial Activity

CrypTap does not provide investment advice, brokerage services, or trading recommendations, engage in discretionary trading activity, manage assets on behalf of users, execute transactions at CrypTap's discretion, select counterparties for users, or route customer orders between competing venues or liquidity providers. CrypTap functions solely as non-custodial blockchain payment infrastructure facilitating user-authorized blockchain interactions.

9 No Fiat Conversion or Banking Services

CrypTap does not convert digital assets into fiat currency, operate fiat settlement accounts, provide banking services, offer lending products, provide deposit accounts, issue credit, or provide investment management services. Blockchain transactions facilitated through CrypTap occur through blockchain networks and third-party wallet infrastructure.

10 Third-Party Wallets, Protocols & Blockchain Infrastructure

CrypTap relies upon third-party systems including blockchain networks, wallet providers, RPC providers, smart contract systems, cloud infrastructure providers, open-source software, wireless communication infrastructure, and mobile operating systems. CrypTap does not control blockchain network availability, transaction confirmation timing, gas fee pricing, blockchain governance decisions, wallet application behavior, third-party infrastructure uptime, or third-party software security.

11 Smart Contract & Protocol Risks

Users acknowledge that smart contracts may contain vulnerabilities, blockchain protocols may fail or experience outages, protocol-level exploits may occur, blockchain software may contain bugs or limitations, and blockchain systems remain experimental and evolving technologies. CrypTap does not guarantee uninterrupted or error-free operation of smart contract infrastructure, blockchain communication systems, payment-intent infrastructure, or operational wallet systems.

12 Risks Associated with Blockchain Technology

Use of CrypTap involves significant technical, operational, and financial risks including digital asset volatility, smart contract vulnerabilities, irreversible transactions, wallet compromise, operational wallet compromise, insufficient gas balances, phishing attacks, device theft, unauthorized hardware access, blockchain congestion, unsupported wallet behavior, protocol exploits, software incompatibilities, cyberattacks, infrastructure outages, regulatory uncertainty, and evolving legal treatment of blockchain technology.

13 No Guarantee of Regulatory Treatment

Blockchain technology, digital assets, decentralized systems, smart contract infrastructure, and non-custodial payment systems remain subject to evolving legal and regulatory interpretation. CrypTap makes no representation or guarantee regarding future regulatory classification, legal treatment in specific jurisdictions, regulatory outcomes, future licensing requirements, or future compliance obligations applicable to users or merchants.

14 Compliance Responsibilities

Users and merchants remain solely responsible for compliance with applicable laws and regulations, tax reporting obligations, sanctions compliance, consumer protection obligations, and business licensing requirements where applicable. CrypTap reserves the right to restrict or terminate access where unlawful activity is reasonably suspected or where required by applicable law.

15 Limitation of Responsibility

CrypTap shall not be responsible for losses arising from wallet compromise, operational wallet compromise, insufficient gas balances, failed smart contract execution, payment-intent deployment failures, private key loss, seed phrase disclosure, incorrect wallet addresses, unsupported blockchain networks, wrong-network transfers, third-party wallet software failures, delayed or failed confirmations, blockchain outages, protocol exploits, unauthorized device access, hardware tampering, user error, or regulatory actions affecting blockchain networks or digital assets.
