1 Eligibility
You must be at least 18 years old and legally capable of entering into binding agreements to use the Services. By using CrypTap, you represent and warrant that you have the legal authority to use the Services, your use complies with applicable laws and regulations, and you are not prohibited from using the Services under applicable sanctions or trade restrictions.
2 Description of Services
CrypTap provides non-custodial blockchain payment infrastructure designed to facilitate blockchain-based payment interactions between users and merchants. CrypTap Services may include hardware payment devices, blockchain payment-intent infrastructure, smart contract interaction systems, merchant interfaces and dashboards, APIs and software applications, wallet-triggering infrastructure, blockchain communication systems, and operational device-wallet infrastructure. CrypTap may utilize smart contract systems and blockchain infrastructure to facilitate payment-intent generation, transaction routing logic, blockchain interaction workflows, protocol-level fee processing, and operational blockchain execution. CrypTap does not custody customer funds, custody merchant settlement funds, hold customer or merchant private keys, maintain pooled user accounts or omnibus accounts, operate escrow accounts, function as a bank or financial institution, or provide brokerage, investment, or asset management services. Blockchain transactions are executed through blockchain networks and third-party wallet software. CrypTap may operate non-custodial automation systems, including keeper or relayer infrastructure, to submit blockchain transactions, deploy or finalize invoice/payment contracts, monitor payment status, and facilitate contract-enforced settlement. Such automation may front blockchain gas or execution costs and may be reimbursed from merchant-funded operational gas balances where applicable. CrypTap-operated automation does not receive, custody, or control customer payment funds or merchant settlement funds, and settlement remains governed by applicable smart contract logic.
3 Non-Custodial Nature of CrypTap
Users and merchants maintain sole control over wallets, private keys, seed phrases, blockchain accounts, digital assets, and merchant-controlled CrypTap devices. CrypTap cannot access customer or merchant private keys, reverse blockchain transactions, recover lost digital assets, freeze blockchain wallets or accounts, or guarantee transaction completion. Users and merchants remain solely responsible for reviewing and authorizing blockchain transactions before submission.
4 Device-Based Operational Wallet Infrastructure
Certain CrypTap hardware devices may contain locally generated and locally stored cryptographic keypairs used solely for operational blockchain interactions associated with payment-intent infrastructure, smart contract deployment, operational blockchain execution, protocol-level transaction functionality, and operational gas management. Users and merchants acknowledge and agree that operational device keypairs are generated locally on CrypTap hardware devices during setup, operational device private keys remain locally stored on CrypTap hardware devices, operational device private keys do not leave the CrypTap device, CrypTap does not centrally store or custody operational device private keys, and CrypTap cannot access, retrieve, or recover operational device private keys. Operational device wallets are separate from customer payment wallets and merchant settlement wallets. Merchants remain solely responsible for maintaining sufficient operational gas balances where applicable, securing merchant-controlled devices, maintaining physical possession and control of devices, and preventing unauthorized device access or tampering.
5 User Responsibilities
You are solely responsible for securing your wallets, devices, and credentials, verifying transaction details, reviewing blockchain interactions prior to authorization, selecting compatible blockchain networks, maintaining sufficient blockchain gas balances where applicable, complying with applicable laws and regulations, and all activity associated with your wallets, accounts, or devices. CrypTap is not responsible for losses resulting from user error, incorrect wallet addresses, wrong-network transfers, insufficient gas balances, wallet compromise, blockchain congestion, failed or delayed transactions, smart contract execution failures, third-party wallet software failures, unsupported wallet behavior, hardware misuse or tampering, or blockchain infrastructure failures outside CrypTap's control. CrypTap may collect, store, review, and maintain transaction metadata and blockchain payment activity associated with use of the Services, including payment intent data, merchant account identifiers, wallet addresses, invoice or payment contract addresses, transaction hashes, blockchain network, token type, payment amount, timestamps, checkout status, webhook delivery status, device or session data, and related operational logs. CrypTap uses this information to provide payment status, receipts, merchant reporting, analytics, customer support, fraud prevention, security monitoring, sanctions and compliance review, dispute handling, legal recordkeeping, and enforcement of these Terms. Merchants acknowledge that blockchain transactions are generally publicly visible and that CrypTap may monitor transactions associated with CrypTap payment infrastructure. CrypTap's collection, monitoring, or recordkeeping of transaction information does not mean that CrypTap custodies customer funds, custodies merchant funds, controls merchant wallets, or controls customer wallets. Users are solely responsible for ensuring that the correct digital asset, blockchain network, payment amount, destination address, and transaction details are selected before authorizing a transaction. CrypTap is not responsible for digital assets lost, inaccessible, or unrecoverable as a result of a user sending an incorrect token, using an incorrect or unsupported blockchain network, sending an incorrect amount, sending funds outside the CrypTap payment flow, or otherwise deviating from the payment instructions presented through the Services. Blockchain transactions may be irreversible, and CrypTap may be unable to recover or redirect incorrectly transmitted digital assets.
6 Merchant Responsibilities
Merchants using CrypTap agree to maintain lawful business operations, comply with applicable laws, tax obligations, and regulations, maintain accurate merchant payout wallet information, maintain operational gas balances where applicable, secure merchant-controlled CrypTap devices and wallets, avoid prohibited transactions or industries, and maintain appropriate business records where required. Merchants remain solely responsible for products and services sold, customer support, refunds and disputes, blockchain wallet management, and operational blockchain costs associated with merchant-controlled infrastructure. CrypTap reserves the right to suspend or terminate merchant access where unlawful, fraudulent, prohibited, or security-related activity is reasonably suspected. CrypTap may collect, store, review, and maintain transaction metadata and blockchain payment activity associated with use of the Services, including payment intent data, merchant account identifiers, wallet addresses, invoice or payment contract addresses, transaction hashes, blockchain network, token type, payment amount, timestamps, checkout status, webhook delivery status, device or session data, and related operational logs. CrypTap uses this information to provide payment status, receipts, merchant reporting, analytics, customer support, fraud prevention, security monitoring, sanctions and compliance review, dispute handling, legal recordkeeping, and enforcement of these Terms. Merchants acknowledge that blockchain transactions are generally publicly visible and that CrypTap may monitor transactions associated with CrypTap payment infrastructure. CrypTap's collection, monitoring, or recordkeeping of transaction information does not mean that CrypTap custodies customer funds, custodies merchant funds, controls merchant wallets, or controls customer wallets.
7 Fees
CrypTap may charge transparent protocol or service fees associated with use of the Services. Applicable fees may vary by blockchain network, vary by transaction size, and evolve over time. Blockchain transactions may require blockchain gas fees, validator fees, smart contract execution costs, and operational blockchain costs. Such fees are determined independently by applicable blockchain networks. CrypTap does not hold merchant settlement balances or customer transaction proceeds.
8 Taxes
Users and merchants remain solely responsible for determining tax obligations, maintaining records, reporting taxable activity, and complying with applicable tax laws. CrypTap does not provide tax, accounting, or legal advice.
9 Acceptable Use
You may not use CrypTap for money laundering, terrorist financing, sanctions evasion, unlawful transactions, fraud or deceptive conduct, illegal goods or services, counterfeit goods, adult exploitation, gambling where unlawful, transmitting malicious software, unauthorized access attempts, device tampering, unauthorized manipulation of smart contract infrastructure, firmware exploitation, infringement of intellectual property rights, or any business requiring licenses the merchant does not hold.
